By accessing or using the T-TITANS website at teletitans.com or engaging our services, you agree to be bound by these Terms of Service. If you do not agree, please do not use the website or our services.
These Terms incorporate our Privacy Policy and, where you participate in our text messaging programme, our SMS Terms & Conditions.
2. Services
T-TITANS provides appointment setting, lead generation, cold calling, sales support and CRM management services, principally for businesses in the solar, real estate, roofing and home remodeling sectors within the United States. The specific scope, deliverables, fees and term of any engagement are governed by a separate written services agreement or statement of work between us and the client.
Where those documents conflict with these Terms, the signed services agreement takes precedence.
3. Use of the website
You agree to use this website only for lawful purposes. You may not:
- use the website in any way that violates applicable law or regulation;
- submit false, misleading or third-party information through our forms;
- submit a mobile number you are not authorised to provide consent for, or provide consent on someone else’s behalf without their authority;
- attempt to gain unauthorised access to our systems, accounts or administrator areas;
- use automated tools to scrape, harvest or collect data from the website, or to submit forms;
- interfere with the operation, security or availability of the website.
4. Appointments and bookings
When you book a demo through this website, you agree to provide accurate contact details. We reserve the right to cancel or reschedule appointments at our discretion, and will give you as much notice as we reasonably can. Booking a demo creates no obligation on either side to enter into a services agreement.
5. Calls and messages
By providing a telephone number you agree that we may contact you at that number about your enquiry. Calls may be recorded or monitored for quality assurance, training and consent verification where permitted by law, and you will be notified before any recording begins.
Text messages are sent only with your separate express consent and are governed by our SMS Terms & Conditions. You may withdraw consent at any time by replying STOP. Consent to receive text messages is never a condition of purchasing any goods or services.
6. Client obligations for outreach campaigns
Where we perform calling or messaging on your behalf as a client, you represent and warrant that:
- you have the legal right to provide us with any contact list, and it was lawfully obtained;
- you hold, and can evidence, any consent required by the Telephone Consumer Protection Act, applicable state telemarketing laws and carrier messaging rules for the outreach you ask us to perform;
- you have scrubbed the list against applicable federal, state and internal do-not-call registries, or have instructed us to do so;
- you will honour and record opt-out requests we pass back to you, promptly and permanently.
We may suspend or terminate a campaign immediately if we reasonably believe it does not comply with applicable law or carrier policy.
7. Intellectual property
All content on this website — including text, graphics, logos, marks and software — is the property of T-TITANS or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify or create derivative works from it without our prior written permission.
Scripts, call frameworks and campaign materials we develop for a client remain licensed to that client for the term of the engagement as set out in the applicable services agreement.
8. Limitation of liability
To the maximum extent permitted by law, T-TITANS shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising out of or in connection with the website or our services.
Our total aggregate liability arising out of or relating to the services shall not exceed the amount paid by you to us for services in the twelve months preceding the event giving rise to the claim.
9. Disclaimer
The website and our services are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.
While we work to deliver high-quality appointments and leads, we do not guarantee any specific number of appointments, conversion rate, revenue outcome or return on investment. Any figures shown on this website are illustrative of past client experience and are not a promise of future results.
10. Indemnity
You agree to indemnify and hold harmless T-TITANS, its officers, employees and agents from any claim, demand, loss or expense (including reasonable legal fees) arising from your breach of these Terms, your misuse of the website, or — where you are a client — any claim that outreach we performed on your instructions lacked the consent or list rights you warranted in section 6.
11. Governing law
These Terms are governed by the laws of the United States and the State in which T-TITANS is organised, without regard to conflict-of-law principles. Any dispute shall be brought exclusively in the state or federal courts located in that State, and you consent to their jurisdiction.
12. Changes to these terms
We may modify these Terms at any time. Changes are effective when posted to this page, and the “last updated” date will be revised. Your continued use of the website or our services constitutes acceptance of the updated Terms.
